Some Notable Cases

*Toro Aluminum Ltd. v. Revah: Mr. Romano successfully represented the plaintiff in obtaining judgment in the first case in Ontario which determined that a judgment obtained for breach of trust pursuant to a breach of trust claim brought under the Construction Lien Act of Ontario could still be enforced even though the defendant/judgment debtor made an assignment into and was discharged from bankruptcy.

*859687 Ontario Ltd. (cob Atlantic International Equipment Sales) v. Starmark Property Management Ltd.: The “Atlantic v. Starmark” decision, reported in the Dominion Law Reports, is considered one of the leading cases in determining the competing rights of a commercial landlord and a secured creditor with respect to a trade fixture. Mr. Romano successfully represented the interests of the secured creditor over the landlord’s claim.

*Prinzo v. Baycrest Centre for Geriatric Care: Also reported in the Dominion Law Reports, Mr. Romano represented Ms. Prinzo in her wrongful dismissal claim. The “Prinzo” decision was the first case in Ontario where damages were awarded to a wrongfully terminated employee as an independent tort for intentional infliction of mental suffering.
